The Supreme Court on Friday issued notice on a petition filed by Anil Ambani-owned Reliance Energy Ltd seeking transfer of a petition challenging acquisition of land by the company for setting up of a special economic zone in Noida, Uttar Pradesh. A bench headed by Chief Justice K.G. Balakrishnan while issuing notice to respondent Mr Sohan Pal Sharma (petitioner before the Allahabad High Court) also tagged the petition with similar matters pending before it.
Mr Sharma had moved the High Court challenging the provisions of the SEZ Act. He had also sought quashing of the agreements and permissions granted by the Uttar Pradesh government to the company. REL counsel Mr Harish Salve and Mr Mukul Rohtagi stated that the petition (Mr Sohan Pal Sharma vs Union of India) pending before the High Court should be transferred in view of several other similar petitions pending before the SC.
"It is in the interest of justice that this court withdraws writ petition pending before the hc and adjudicate the same so that multiplicity of proceedings is avoided," the REL petition stated.
